Doğum yapan kadın işçi, 4857 sayılı İş Kanunu gereği öncelikle doğum öncesi ve doğum sonrası için tekil gebeliklerde 16 hafta süren analık raporu boyunca izinli sayılacaktır. Analık raporu sona erdikten sonra yine İş Kanunun gereği Kadın işçiye, analık izninin bitiminden itibaren isteği hâlinde altı aya kadar ücretsiz izin verilecektir.
Çalışan ücretsiz doğum izni kullanmak istiyorsa, en geç 1 ay önce işverene yazılı olarak bunu bildirmek zorundadır. İşveren çalışanın bu izin talebini karşılar, ücretsiz doğum izninde olduğu sürece iş sözleşmesini askıya alır ve işçiye ücret ödemez.
Kadın işçilerin doğumdan önce ve sonra çalıştırılmasının yasak olduğu toplam 16 haftalık (çoğul gebelikte 18 haftalık) süre, kıdem tazminatının hesaplanmasında kıdemden sayılır. Bu süre yıllık ücretli iznin hak edilmesi bakımından da çalışılmış gibi sayılan haller arasında yer almaktadır. 4857 sayılı İş Kanunu’nun 55. maddesinde yıllık izin bakımından çalışılmış gibi sayılan hallerde doğum izinlerini de saymaktadır.
Ücretsiz izin ise , çalışanın ücret almadığı ve çalışmadığı sürelerdir. Bu süreçte çalışanın iş sözleşmesi askıda olmaktadır. İş sözleşmesinin askıda olması, iş sözleşmesinin sona ermeden sadece çalışmaya ara verilmiş olmasıdır.
4857 sayılı iş kanunun da doğum sonrası ücretsiz izin kullanan kadın işçinin ücretsiz izin süresinin Kıdem Tazminatına dahil edilip edilmeyeceği hususun da bir açıklık getirilmemiştir.Bu nedenle uygulama da ücretsiz doğum izni de diğer ücretsiz izinlerinden farkı olmaksızın iş sözleşmesini askıya almaktadır. Bu sürede işçi çalışmamış kabul edilir ve kıdem süresi işlemez.Kıdem süresinin ücretsiz izin süresi boyunca işlemiyor olması, kıdem süresine bağlı hak edişlerde de bu sürenin hesaba katılmayacağı sonucunu getirir. Yıllık izin hak edişleri hesaplanırken de ücretsiz doğum izninden olunan süreler hesaba katılmadan kıdem süresine bakılacaktır.
Yıllık izin en az 1 yıl çalışma sonunda, gelecek hizmet yılı içinde kullanılmak üzere hak edilmektedir. 6 ay ücretsiz doğum izni kullanmış bir işçinin yıllık izin hak ediş tarihi 6 ay ileri ötelenmiş olacaktır.
Sonuç itibariyle ; Yargıtay kararların da, iş sözleşmesinin askıda olduğu süreler gibi çalışılmayan ya da kanun gereği çalışılmış sayılmayan süreler kıdemden sayılmamakta, kıdem tazminatına esas hizmet süresinin, ücretsiz izin süreleri düşüldükten sonra kalan süre olduğu belirtilmektedir. Buna göre, 16 (ya da 18) haftalık iznin bitiminden sonra 4857 sayılı İş Kanunu madde 74’e göre kadın işçinin talep etmesi durumunda işverenin vermek zorunda olduğu ücretsiz izin kıdemden sayılmayacaktır.
